EPISTEMIC INJUSTICE AND GENDER ISSUES
The case of hermeneutic injustice in the distinction between homoaffectivity and heterosexuality

: This paper aims to understand the concept of hermeneutic injustice, as well as comprehend by what means this concept relates to gender issues, in this case, the LGBTQIA+ community. In order to achieve these goals, the works Epistemic Injustice (2007) by Miranda Fricker and Homoafetividade e os Direitos LGBTI (2013) by Maria Berenice Dias will be explored, as well as the trial for the Direct Action of Unconstitutionality 4277/DF by the Supreme Federal Court. The methodology to be used is the bibliographic review with special attention to the works previously mentioned and other complementary texts. The results demonstrate that the hermeneutic construction influences gender and State through a twofold action, as it is present both in the theoretical and legal constructions, as well as in the constitution of the subjects’ sexual identities.
