The research is interested in a study about the origins of our moral concepts and how they could have influenced the implementation of our legal norms. According to the Nietzschiana interpretation, translated by Mario Ferreira dos Santos, the notion of justice must be understood in a genealogical way, which, in this way, would allow us to understand its origin in cruel actions, unlike that thought by the Enlightenment of Jean-Jacques Rousseau and positivist currents of Hans Kelsen. The idea of justice aligned with the assumption of cruelty is revealed in this study as the oldest and longest lasting substrate of culture. In order to examine precisely this hypothesis, we will investigate by the translation of the Brazilian author the relation that the German philosopher establishes with his own readings, and that which he hopes to establish with his own readers, in the hope of arriving at an instigating and original form of understanding about new Concepts that contribute to the insertion of different perspectives for the right.
